The tiny Michigan town of Grosse Pointe Farms, outside of Detroit, went to great lengths to pass strict laws on cryptocurrency ATMs even though the town has zero. This radical move will safeguard locals against rising crypto ATM frauds witnessed in neighboring towns.
Tuesday, the city council passed an ordinance unanimously that would require registration, licensing, and limit transactions of any crypto ATM operator in the future in order to combat fraud. That is after there are reports of local scams and statewide alerts by the Attorney General of Michigan, Dana Nessel.
Shielding Residents Before the Threat Arrives
Grosse Pointe Farms was quick to act following a case where one of their residents became a victim of a crypto ATM scam in the adjacent St. Clair Shores. City officials observed the shadiness of crypto ATM activity as a potential weakness and wanted to increase transparency and responsibility.
The councilmember Lev Wood, said that the purpose of the ordinance would serve to give residents a little bit of help by requiring clear consumer protection warnings and disclosures about the risk of fraud on all crypto ATMs. People are being asked by the crooks to feed the machines with money, and it is a very opaque thing, said Wood.
New Regulations Set Strong Guardrails
The new regulations mean that all the crypto kiosks should be registered by the Department of Public Safety and that the operators should acquire a business license. In addition to making on-screen and written notices compulsory, they also caution consumers on possible fraud and sound the alarm that crypto transactions are irreversible.
More importantly, the ordinance limits the transactions of new users during the first 14 days: daily $1,000 and cumulative $5,000. Thereafter, restrictions are removed to permit more flexibility.
According to city attorney Bill Burgess, the limits provide a user with time to get used to the use of the ATM, and therefore, there is a slim chance of making major and impulsive fraudulent transactions.
Those proposals were backed by Coinflip representatives, a Chicago crypto ATM operator that was licensed in Michigan since 2019. One of the representatives of Coinflip also reported cases when employees helped to avoid scams, especially among older users. They have also given thought to holding periods in initial transactions as a way of protecting first-time customers.
The ordinance makes Grosse Pointe Farms a possible first municipality in Michigan to regulate crypto ATMs comprehensively, along with Arizona, California, and Washington, other states that recently clamped down on crypto ATM abuses.
